1. Agreement to Terms

By accessing or using MemeForge ("the Service") at quickmeme.io, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

MemeForge is operated by MemeForge ("we," "us," or "our"). These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

MemeForge is a free, browser-based meme generator that allows users to:

• Select from a library of pre-made meme templates
• Upload custom images to create memes
• Add and customize text overlays
• Generate AI-powered caption suggestions (limited free tier)
• Export memes as PNG files
• Share meme creations on social media

All meme creation is performed client-side in your browser. We do not store, host, or process your custom images on our servers.

3. User Responsibilities

You agree to:

• Be at least 13 years of age to use the Service
• Use the Service only for lawful purposes
• Not violate any applicable laws or regulations
• Not infringe upon the intellectual property rights of others
• Not upload malicious files or code
• Not attempt to reverse engineer, hack, or disrupt the Service
• Not use automated tools (bots, scrapers) without permission

5. Prohibited Content

You may not create or share memes that contain:

• Illegal content or content promoting illegal activities
• Hate speech, harassment, or threats of violence
• Content exploiting or harming minors
• Sexually explicit or pornographic material
• Copyrighted material you don't have rights to use
• Malware, viruses, or malicious code
• Spam, phishing, or fraudulent content
• Private information of others without consent

While we don't monitor or moderate content (since it's created client-side), we reserve the right to remove meme templates or block access if we become aware of violations.

6. AI Caption Suggestions

Our AI caption suggestion feature is provided "as is" without guarantees of:

• Accuracy, appropriateness, or quality of suggestions
• Freedom from offensive or controversial content
• Continuous availability (we may limit or suspend the feature)

Free users are limited to 5 AI caption suggestions per day. This limit may change at our discretion.

You are responsible for reviewing and approving all AI-generated content before using it. We are not liable for how you use AI suggestions.

7. Service Availability

We strive to keep MemeForge available 24/7, but we make no guarantees. The Service may be:

• Temporarily unavailable due to maintenance, updates, or technical issues
• Modified or discontinued at any time without notice
• Restricted or limited in certain regions

We are not liable for any loss or damage resulting from service interruptions or unavailability.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEMEFORGE SHALL NOT BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Damages resulting from unauthorized access to your data
• Damages resulting from content created by you or other users

This limitation applies regardless of the legal theory (contract, tort, negligence, etc.) and whether we were advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless MemeForge, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create, upload, or share

11. DMCA Copyright Policy

We respect intellectual property rights. If you believe content on MemeForge infringes your copyright, please send a DMCA notice to:

• Identification of the copyrighted work
• Identification of the infringing material and its location
• Your contact information
• A statement that you believe in good faith that the use is unauthorized
• A statement that the information is accurate and you are authorized to act

We will review valid DMCA notices and remove or disable access to infringing content as required by law.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to the Service immediately, without notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MemeForge regarding the Service and supersede all prior agreements.
